By Linda Chiem (August 23, 2022, 5:04 p.m. EDT) – The Tenth Circuit says SkyWest Airlines faces a personal injury lawsuit from a passenger alleging that a flight attendant negligently struck her with a beverage cart, concluding that federal law governing airline operations does not protect SkyWest from passenger claims.
A three-judge appeals court panel on Monday overturned a Utah district court’s dismissal of Kelly Day’s lawsuit seeking damages for injuries she allegedly sustained when a flight attendant of SkyWest shoved a beverage cart into his shoulder aboard a January 2019 flight from Oregon to Texas.
The panel said Day’s negligence and breach of contract claims are not anticipated by the airline…
